Kittens are adopted on a first come first serve basis. A $300.00 non refundable deposit and a signed contract are required to hold the kiiten of your choice.

TO THE BUYER
BellaRemembered Cattery requires a $300.00 non-refundable deposit to reserve a kitten/cat.  This deposit will go towards the total agreed upon price.

Bella Remembered Cattery, Donna Barnes, Hereinafter referred to as “Seller” and kitten/cat will carry the BellaRemembered name.

This kitten/cat sales contract entered into on _____________________
Between Donna Barnes, (Seller) and ____________________________
(Buyer).

(1) The price of the above kitten/cat is US $___________includes a US $____________non-refundable deposit due for reservation of kitten/cat. Balance plus shipping fees shall be paid if full 2 weeks prior to the date Seller tells buyer the kitten/cat is ready to leave the sellers home. If the kitten/cat is not paid in full by the shipping date the kitten/cat will not be shipped .If not paid in full two weeks after shipping date this contract will be null and void and the buyer will forfeit all money paid on said kitten/cat. After this time frame the kitten/cat will then be resold. All shipping, insurance and airline carrier charges shall be paid by the buyer. The seller is not responsible for any kitten/cat that gets lost or stolen after acceptance by the airline carrier. It is the responsibility of the buyer to file a claim with the airline carrier if the kitten/cat is lost, stolen, damaged, delayed or results in the mortality of the kitten/cat.

(2) If the kitten/cat is being sold as a pet only it should be spayed or neutered prior to leaving. If this is not done prior to leaving unless otherwise specified, the buyer will have four months to do it allowing them the time frame that some licensed vets will not do this procedure until the kittens are at least 6 months old. TICA/CFA registration papers will be provided once the proof is signed by a licensed vet and sent back to us. If the kitten/cat is sold as a show cat, we cannot guarantee their performance in the ring or how they will develop as they grow or even if they will tolerate it. Although some cats are show quality, not all cats enjoy that environment.

(3) The seller provides a 4 day limited guarantee that the above kitten/cat is in good health at the time of purchase. Seller is not responsible for vet bills after 4 days of buyers receiving the kitten. It is the responsibility of the buyer to take the kitten/cat to a veterinarian within this time for a thorough examination. Failure to have the kitten/cat checked by a licensed veterinarian will void guarantee. It is recommended that the kitten/cat be quarantined for a period of one week before being introduced to other cats in your household. If the kitten/cat has been determined by a licensed veterinarian to have anything that is genetically wrong with it the seller will replace it with a kitten of equal value when one becomes available. There will be no money refunded. The seller has the right to have a second opinion by a vet of his/her choice. Transportation and all veterinary costs are the responsibility of the buyer. After 4 days of the health guarantee period, the seller cannot be held accountable for future diagnosis of Felv/Fiv/Fip, or any other bacterial or viral infectious diseases, gierida, parasites, or fungus, due to the fact that these can be contracted anywhere in the environment after leaving the cattery and are not a result of genetics or breeding. Buyer accepts all responsibility for protection of cat from said, diseases, illnesses, parasites, and fungi. This kitten/cat is guaranteed against congenital defects for one year from the date on this contract. If the kitten should die within the guaranteed one year the seller has the right to request an autopsy be perform to determine cause of death. Based on lab findings, seller may replace said kitten when one becomes available. Purchaser is responsible for shipping.  If seller cannot replace with a new kitten within one year, seller will refund to the buyer the price of the kitten only.

(4) The seller will have completed all of the shots such as the appropriate vaccinations, worming, medical examining and altering by time of purchase. If the buyer chooses to vaccinate for the Feline Infectious {peritonitis (FIP, Ringworm, Giardia, Feline Leukemia Virus FeLV, or Feline Immunodeficiency Virus (FIV) the warranty is NULL and VOID. Also, the seller does not warranty the kitten/cat against any adverse reactions to future vaccinations.

(5) It is understood that degrees of hairlessness in Sphynx vary from cat to cat and that no Sphynx is completely hairless. It is understood that hormones, climate change, and genetics play an important role in hairlessness when sold, and it is possible that above kitten/cat could develop some hair after being neutered/spayed or as it grows older. It is also impossible to guarantee that any Sphynx kitten/cat will not grow some hair at some point in the future.

(6) Seller has the conditional right to reclaim kitten/cat without refund of purchase price for any breech of contract. Breech of this contract will have a penalty fee, which is the purchase price of the above kitten/cat.

(7) Any legal action, which may arise under the terms of this contract, will be brought in California, USA. Buyer shall be liable for any court costs and related charges including attorney’s fees associated with the seller enforcing the terms of this contract. In signing this document, Buyer acknowledges that he/she has read, understands and agrees to ALL of the terms and conditions stated above. The laws of the state of California shall be controlling.

(8) Signatures and dates below indicate full agreement to ALL terms set forth in this contract. There are neither other conditions nor guarantees, verbal or implied. No verbal deviations or additions are valid. No other warranties or guarantees are provided other than those specifically outlined above. The above signed consider this document to be legally binding. Changes or additions to this contract must be initialed by all parties involved.

Addendum to Bella Remembered Spnynx Cattery’s Breeders Contract:

Kittens/cats sold for breeding will only be breed to show quality, purebred Sphynx cats. No out crossing is allowed unless consent is given.

I understand that I do NOT have the rights to breed this kitten. I also understand that I will receive the pedigree papers when I provide proof that this kitten has been spayed/neutered. Any breech of this contract can result in the seller taking repossession of the cat.
